These Terms describe the Services which Donate 4 Refugees (“D4R”) provide for Refugee Response Volunteers registering at www.donate4refugees.org.uk (“D4R Website”). They set-out the obligations of Refugee Response Volunteers, whether registered or unregistered charities, individuals, or groups of volunteers (“Volunteers”), when using this service. D4R is Charity Registration Number 1168435.
D4R is a no fee online fundraising service for UK based Volunteers. The D4R service (“Services”) is provided for the sole purpose of supporting Volunteers in delivering humanitarian aid by providing an umbrella charity and simplifying the donor experience (to facilitate more donations).
The Services include:
the operation of the D4R Website, Facebook page, Twitter account and other such social media as is deemed useful
the provision of a Grant request made available on the D4R Website
promotional material relating to D4R
the collection of charity donations via numerous payment channels – on and off-line
the management and collection of Gift Aid from HMRC
the operation of a D4R eBay site
transfer of agreed Grant funds from D4R and Volunteers
For the purposes of D4R a Refugee is someone who has been forced to flee his or her country because of persecution, war or violence.
1. Registering as a Volunteer to use the Service
1.1 To use D4R Services you must be actively supporting Refugees in the UK or overseas as a Volunteer. You cannot take any reimbursement, payment or other salary for your activities. You must not receive any government funding or government grants. You must operate from the UK.
1.2 You can be (a) an active registered charity (with the Charities Commission for England and Wales, the Office of the Scottish Charity Regulator or the Northern Irish Charity Commission, and her Majesty’s Revenue and Customer (HMRC); (b) an active non-registered charity; (c) an active individual volunteer; or (d) an active group of volunteers.
1.3 There is no limit to the number of Volunteers registered with D4R.
1.4 You must complete the D4R Volunteer registration form on the D4R Website.
1.5 You agree that we may carry out any checks we consider necessary to verify your identity and confirm the information you provide in your completed registration form is correct. Such checks may be carried out at any time during your registration and receipt of Services with D4R.
1.6 Acceptance of your registration is at D4R’s sole discretion. Once we have accepted your registration we will provide you with the Services unless or until it is suspended or terminated in accordance with the relevant clauses of these terms.
1.7 If we reject your registration we will inform you of the reasons why and endeavour to remain in open dialogue with you to resolve any issues, if applicable, such that we can accept your registration on re-submission.
1.8 You are responsible for ensuring that all information provided during registration is accurate and complete, and that you will keep it up to date for the period you use the Services. You must inform D4R of any material developments or changes as a Volunteer which might affect your use of the Services including, but not limited to, any change in your charity status or if the charity commission opens an enquiry relating to you/your activities. Particularly in such circumstances D4R reserves the right to suspend your registration at any time – immediately and without notice.
1.9 Registered Volunteers authorise D4R to use information provided by the Volunteers during Registration – and from time to time provided for other means - including, but not limited to, logos/brand images, vision and mission statements, website URLs, Facebook links, photos and videos, on the D4R website and in other promotional material as applicable in support of the successful delivery of D4R fundraising activity.
1.10 Successful registration gives you access to D4S Services; notably applying for Grants to fund specific Aid projects.
1.11 You must comply with the requirements of charity law, anti-discrimination, anti-corruption and anti-bribery laws and, if relevant, company law (“Legal Obligations”).
2. Requesting Grants and Reporting Delivery
3. Operation of the D4R Website
3.1 As a minimum, Volunteer logos/brand image and a link to your website or Facebook page will be published on the D4R Website.
3.2 We enable donors to make payments to us via multiple payment channels including, but not limited to, direct debit, credit card, PayPal, text message, MyDonate and Virgin Money, in order to give donors choice to use their preferred payment method.
3.3 We reserve the right to decline to process any donations if we have reasonable grounds to believe that such transactions are related to any fraudulent activity of any kind.
3.4 Donations of items will be facilitated by our eBay team and the donor will either be sign-posted to current known collections for Refugees by Volunteer or other parties, or else we will accept the item and sell it via the D4R eBay (Seller only) shop where proceeds from sales are credited via PayPal to the D4R bank account directly. 3.5 We publish our costs and aim to pass on 100% of our fundraising to Volunteers in Grant payments.
3.6 So that they can be confident we will not follow up with unwanted, unsolicited emails, phone calls or mailings requesting more money, we do not request contact information for our donors. However, whenever possible we will request from donors the minimum information needed to reclaim Gift Aid on their donations.
3.7 Donations can be made in different currencies depending on the donation method. D4R operates in sterling.
4. Data Protection
4.1 When donors visit the D4R Website and decide to make a donation, the donation will actually be made on a third party page such as PayPal or MyDonate. Each third party has different processes regarding recording of contact information and our access to those details. D4R Website does NOT record the name and contact information of visitors or require any donor registration. We do not share donor information with you. This is an integral part of our privacy offering to donors.
4.2 As previously stated, minimal donor information will be requested solely to enable Gift Aid administration and collection from HMRC as appropriate.
4.3 A Contact Us form is available to any D4R Website visitor or donor should they wish to contact us for any reason at all.
4.4 Both parties agree that they act as a Data Controller in respect of any donor personal data which they process in connection with the provision and receipt of the Services and we both agree to comply with our respective obligations under the Data Protection Act 1998 and any other data protection, privacy or similar laws in connection with any donor or other personal data which may be processed by either party during the operation and use of the Services. You agree to provide us with help and co-operation as is reasonably necessary or requested by us to enable compliance with this clause.
5. Content Provided by You
5.1 Any content which you submit to us on the D4R Website or which you post on your website or Facebook page, to which there is a link from the D4R Website, must not contain illegal material or link to material which is illegal wherever hosted, nor be defamatory, obscene or offensive to others on any grounds.
5.2 If you believe content that is posted by other users on the D4R Website is of a defamatory nature you may contact us on email@example.com. If, after investigation, we agree that the content is defamatory we will remove that content as soon as practicable and, in any case, no more than 72 hours after reaching our conclusion.
5.3 You should not publish or link to any material or content for which you do not own the rights without the permission of the owner of the relevant rights.
6. Usage of Brands & Logos
6.1 The name “Donate 4 Refugees”, or any variation, along with the D4R logo may be used only by Registered Volunteers on their own websites, Facebook pages or other social media, and in relation to their participation in D4R or with the aim of increasing traffic to the D4R Website.
6.2 The domain name and charity operating as www.Donate4Refugees.com is separate and in no way affiliated to Donate4Refugees.org.uk. We do not assume to give permission to use their logo or information in any way to any party.
6.3 They may not be used in connection with any product or service that is likely to cause any confusion or in any way that may disparage or discredit us.
6.4 Other trademarks, service marks or logos that appear on the D4R Website, in particular (but not exclusively) those of other registered Volunteers, are the property of their respective owners and subject to their restrictions as to their use. We are not in a position to, nor do we assume to, give permission for their use by any other party in any way.
6.5 You agree to permit us to use your name and logo in respect of your participation in the Services including in respect of promotional materials we may publish from time to time.
7.1 All content on the D4R Website is owned by D4R, registered Volunteers or other original providers. It is protected by the applicable intellectual property and proprietary rights and laws. You may copy content for your own personal, non-commercial use provided you do not alter or remove any copyright, trade mark, photography credits or other proprietary notice.
7.2 No other use of the D4R Website content is permitted without our express consent. Please contact us on firstname.lastname@example.org.
8. Changes to the Service
8.1 We will make every effort to ensure that the Services and the D4R Wesbite are available continuously. We reserve the right to modify, suspend or discontinue all or any part at any time with or without notice.
8.2 Unless specifically exempted, any new features, services or software applications introduced shall be subject to these terms of service.
9. Suspension of the Services
9.1 In the event that you (a) commit a breach of these terms of service; or (b) if we are made aware, or given reason to suspect, that you or the Services are, or may be, being used for illegal or fraudulent purposes, we reserve the right at our sole discretion to immediately and without notice suspend or permanently deny your access to all or part of our Services and to remove your details from the D4R Website without notice pending further investigation.
9.2 For the avoidance of doubt, in the event of fraudulent activity we will inform the police and cooperate fully in any investigation.
10. Termination of the Services
10.2 An act of material breach will be considered to have occurred;
10.2.1 If either party becomes insolvent or wound up; or
10.2.2 If (relating to you) we are made aware, or given reason to suspect because of allegations or reports, that your operations as a Volunteer or your use of the Services have any illegal or fraudulent purposes, or would bring D4R into disrepute; or
10.2.3 Either party commits an act or threatens to do any act the direct result of which is to damage or is likely to damage the reputation of the other party; or
10.2.4 (Where relevant) your charitable status or your HMRC registration is suspended or withdrawn.
10.3 Either you or we may discontinue your use of the D4R Website and Services at any time by the terminating party giving the other 14 days’ prior notice in writing by email. The terminating or suspending party must give the other party a reason for their decision. In this event open Grant requests will be immediately closed un-funded and removed from the D4R Campaigns. All Volunteer commitments to provide information to D4R and our donors relating to previously funded Campaigns must be upheld.
10.4 We reserve the right to withdraw the D4R Website and associated Services from any public access at any time at our complete discretion.
11. Limitation of Liability
11.1 In no event shall we be liable for any claims, loss or damage, whether direct or consequential which you claim to have suffered by reason of your accessing and use of the D4R Website or the Services. This expressly includes any Volunteer activities you carry out as a result of a Grant received from us.
13.1 You agree that your use of the D4R Website is on an “as is” and “as available” basis and that your use of the D4R website is at your sole risk. We do not guarantee continuous uninterrupted or secure access to the Services and operation of the D4R Website may be interfered with by numerous factors including factors which are outside of our control.
13.2 We reserve the right to withdraw the D4R Website and any associated services from any public access at any time and at our complete discretion.
